Terms & Conditions

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("User" or "you") and BrainGainGear ("we," "us," or "our") concerning your access to and use of the BrainGainGear mobile application.

1. Acceptance of Terms

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, you must immediately cease use and uninstall the App.

2. AI-Generated Content Disclaimer

Nature of Content: BrainGainGear uses third-party Artificial Intelligence (AI) to generate educational lessons. You acknowledge that AI-generated content may sometimes be inaccurate, incomplete, or biased.

No Professional Advice: The content provided is for educational and entertainment purposes only and does not constitute professional, medical, legal, or financial advice.

User Responsibility: You are solely responsible for verifying the accuracy of any information provided by the App before relying on it.

3. User Conduct & Content Restrictions

As a condition of use, you agree not to use the App to:

• Generate or prompt the AI to create content that is unlawful, defamatory, obscene, or promotes hate speech.
• Attempt to reverse-engineer, decompile, or disrupt the App's infrastructure.
• Use the App for any automated data collection (scraping) without our prior consent.

4. Intellectual Property

The App: All software, design, logos, and gamification elements (badges, UI/UX) are the exclusive property of BrainGainGear.

Generated Content: Subject to your compliance with these Terms, BrainGainGear grants you a personal, non-exclusive, non-transferable license to use the lessons generated for your personal, non-commercial learning.

5. Gamification and Rewards

The badges and progress tracking features (Streaks, Levels) are for motivational purposes only. They hold no monetary value and cannot be exchanged for currency or physical goods. We reserve the right to reset or modify these features at any time.

6. Limitation of Liability

To the maximum extent permitted by law, BrainGainGear shall not be liable for any indirect, incidental, or consequential damages arising from your use of the App or the inaccuracies of the AI-generated content. Your use of the App is at your own risk.

7. Subscription and Payments

• Payments are processed via the Apple App Store.
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• Refunds are handled exclusively by Apple, according to their refund policy.

8. Termination

We reserve the right to terminate or suspend your account and access to the App at our sole discretion, without notice, for conduct that we believe violates these Terms.

9. Governing Law

These Terms shall be governed by and defined following the laws of the State of Israel. You consent that the courts of Israel shall have exclusive jurisdiction to resolve any dispute.
